Philadelphia Defense Attorney Fighting Gun Charges and Trafficking
The Commonwealth of Pennsylvania and the federal government both include weapons offenses among the crimes that require minimum mandatory sentencing.
If a gun is used in the commission of a crime, or is in your possession at the time of a crime, it adds "enhancements" to your sentence if you are convicted of that crime. For example, if sentencing guidelines give a mandatory minimum sentence of ten years, a weapons offense can add a 6 or 7 point "bump" to your sentencing score. Each bump is 10 months of prison time. You are now looking at 15 years in prison.
Regardless of the seriousness of your crime, possession of a handgun at the time will have a significant effect.
- If you were arrested for felony possession with intent to deliver and you have a gun, 50 months will be added to your time if you are convicted.
- If you are arrested for selling a nickel bag of marijuana, and have an unregistered gun in your pocket, you are now looking at 5 to 10 years in prison.
A large amount of drugs and a large number of guns and you face weapons trafficking charges and possible gang-related charges that could be subject to the terrorist activity provisions under the Patriot Act.
